2020 Changes to Mobile Home Park Act – Purchase Opportunities for Mobile Home Owners

More than 100,000 Coloradans, many on low and fixed incomes, currently live in mobile homes and manufactured housing. To provide this population with affordable, unsubsidized, and self-governed housing, in June 2020 Governor Polis signed into law House Bill 20-1201, which amended the Colorado Mobile Home Park Act to provide these homeowners with the opportunity to purchase the land beneath their homes before it is sold to a third party buyer.

This presentation discusses this significant change to the Mobile Home Park Act, and details the notice, offer, negotiation, and deadline requirements contained in the Act. These requirements will be examined with an eye toward the practical implications for mobile homeowner groups and associations, real estate brokers, sellers, buyers, and finance institutions. This course will also discuss various remedies and dispute resolution mechanisms available through the Division of Housing and the courts.
